Why has no action been initiated against Sada jail officials for Sanjay Chawan’s death?

Jail officials act as mute and willing spectators by not reporting the assault to the police; criminal delay in sending victim to hospital; SDM Mormugao did not record dying declaration inspite of clear intimation by PI Mormugao

MORMUGAO: Sanjay Chawan was arrested in a theft case and sent to Sada jail. Little did he know that he would soon be robbed of his life. The Sada jail, which has gained notoriety for rampant violation of all things a jail should be, has added one more shocking incident in its hall of shame, the literal murder of Chawan, as a result of him getting assaulted on his first day in prison, by a murder accused, who threatened to do more if he reported the brutality.

The Sada jail officials allowed his condition to worsen by not transferring the victim to hospital when he was forced to report his condition to the authorities, three days after the assault. They waited for 12 hours and sent him to the Cottage Hospital when they realised that his health was worsening he was immediately transferred to GMC.
This was coupled by another grave injustice. The Sada jail officials did not report this assault even once. It was GMC which finally did, post which the Mormugao PI asked the Assistant Jail Superintendant of Sada to conduct an inquiry. This again took ten days, after which a case was finally registered against the murder accused inmate who assaulted him. But within a week of the case being registered, the victim died (on October 5), three weeks after he was brutalised.
According to Mormugao PI Kapil Naik, the Mormugao Police did not receive any information about the assault case from jail authorities and it was the casualty section at GMC Bambolim that informed them about the patient admitted in the hospital. “We received a wireless message from GMC that an inmate had been brought to the hospital. Soon after receiving the message, I sent my officers to record the statement of victim. In his statement before the police, the victim confirmed that he was assaulted inside the jail; he, however, refused to give any complaint against any inmate,” Naik said and added, “As the incident was reported inside the jail, I wrote a letter to the jail authorities between September 17 and 18 and asked the Assistant Superintendent of Sada Sub Jail to conduct inquiry on assault case and submit their report.”
The report was received by us on September 28 and simultaneously the jail authorities lodged a complaint against the accused who assaulted the victim inside the jail, he said.
The shocks don’t cease. With the victim in GMC for about 20 days, the SDM Mormugao did not find time to record the dying declaration of the victim, leaving the police to work with just the post mortem report.
PI Naik said, “As the victim was in ICU, we had requested the Sub Divisional Magistrate, Mormugao to record the dying declaration of the victim, however, before making his statement to the SDM, the victim died and now we are awaiting the post-mortem report to conduct further investigation.”
The question we ask is why should action not be initiated against Sada jail officials starting with the jail superintendant? The failure to even report the incident is a clear indication that the jail authorities were trying to shield the accused and had no mercy for the victims.
